Trusts are a means of transferring property or assets from the owner of the property to another person or institution. You select a trustee to manage your assets. There are many kinds of trusts. Some only go into effect when the owner of the property (known as the "grantor") dies. Others, known as living trusts, have the option of taking effect immediately or only after the grantor dies. Revocable trusts can be revoked or changed after they are created. Irrevocable trusts cannot.
Trusts are useful in a variety of circumstances, including:
- When a spouse is unable or unwilling to manage assets
- When there are spendthrift concerns regarding
- Minor children
- Other heirs who are unlikely or unable to manage money wisely
- When a beneficiary is disabled
- When there are blended families
- When assets are located in multiple states
- When creditors are a problem
Why Choose an Irrevocable Trust?
If an irrevocable trust cannot be changed once it is created, why would someone choose this option for his or her estate? Because it offers significant tax advantages. If the grantor wants to avoid income and estate taxes and probate, an irrevocable trust may be the best option. It is also possible to create more than one trust.
